By creating an account, accepting an invitation, purchasing a subscription, or using Molhaven, you agree to these Terms of Service (the Terms). If you use Molhaven on behalf of an organisation, you confirm that you are authorised to bind that organisation.
1. Provider
Molhaven is provided by Anatoli Piven, an individual business registered in Poland, NIP 1133100563, REGON 525700892, postal address: ul. Fabryczna 6/33, 05-077 Warszawa, Poland (the Provider, we, or us).

2. The service
Molhaven is software for managing chemical structures, laboratory inventory, storage locations, analytical records, documents, imports, backups, QR labels, permissions, and audit history. We may improve or update the service while preserving its material purpose.
3. Professional-use eligibility
Molhaven Cloud is offered to businesses, laboratories, universities, research institutions, public bodies, and other professional customers. It is not offered for private consumer use. You must be at least 18 years old and use the service for purposes connected with your trade, business, craft, profession, research, or institutional activity.
4. Accounts and laboratory workspaces
- You must provide accurate registration and billing details.
- You are responsible for protecting your credentials and for activity performed through your account.
- A laboratory owner or administrator controls membership, roles, and access to that laboratory's workspace.
- Tell us promptly if you suspect unauthorised access or account misuse.
5. Free trials, subscriptions, and payment
A new eligible laboratory may receive a 30-day free trial without a payment card. Trial limits and included features are shown on the pricing page or in the application. A trial does not automatically become paid unless an authorised user starts a subscription.
Paid plans are billed in EUR monthly or annually, as selected at checkout. Applicable taxes may be added. Payments are handled by the payment provider identified at checkout. Subscriptions renew for the same billing period until cancelled. Cancellation takes effect at the end of the current paid period; access continues until then.
Except where mandatory law requires otherwise, charges already paid are non-refundable and partial billing periods are not refunded. We will give reasonable advance notice of material price changes, which apply from a future renewal.
6. Customer data
You retain ownership of structures, inventory records, documents, and other content submitted to Molhaven (Customer Data). You grant us the limited right to host, copy, process, transmit, and back up Customer Data only as needed to provide, secure, support, and improve the service and to comply with law.
You are responsible for the accuracy and legality of Customer Data, for having the rights needed to upload it, and for configuring user access appropriately. Each cloud laboratory is logically separated, and its files are stored in a dedicated private object-storage bucket.
7. Acceptable use
You must not:
- use Molhaven unlawfully or infringe third-party rights;
- upload malware or content designed to disrupt, overload, or gain unauthorised access to systems;
- bypass plan limits, access controls, or security measures, or test security without written permission;
- resell or provide the cloud service to third parties unless your agreement expressly permits it;
- use the service to operate illegal chemical activity or to avoid safety, export-control, or regulatory obligations.
8. Availability and support
We aim to keep Molhaven available and secure, but do not promise uninterrupted or error-free operation. Maintenance, security events, third-party infrastructure, or circumstances outside our reasonable control may temporarily affect availability. Support level and response priority depend on the selected plan or a separate written agreement.
9. Intellectual property
Molhaven, its interface, code, branding, and documentation belong to us or our licensors. During an active trial or subscription, we grant you a limited, non-exclusive, non-transferable right to use the cloud service for your internal professional purposes. Self-hosted or dedicated deployments are governed by the applicable order form or licence agreement.
10. Confidentiality and data protection
Each party will protect non-public information received from the other and use it only for the service relationship. We process personal data as described in our Privacy Policy. Where we process personal data contained in Customer Data on your behalf, the parties may enter into a separate data processing agreement where required.
11. Warranties and liability
To the extent permitted by law, the service is provided as available and without implied warranties beyond those expressly stated in these Terms. Neither party is liable for indirect or consequential loss, loss of profit, or loss caused by the other party's systems, instructions, or unlawful conduct.
Our total liability arising from the cloud service is limited to the fees paid for the affected laboratory during the 12 months before the event giving rise to the claim. This limitation does not apply where liability cannot legally be excluded or limited, including for intentional misconduct.
12. Suspension and termination
We may suspend access where reasonably necessary to address a security risk, unlawful use, material breach, or overdue payment. We will normally provide notice and an opportunity to remedy the issue unless urgent action is required.
You may cancel a paid subscription at any time. After the service relationship ends, access may be disabled and Customer Data may be deleted following a reasonable export period, subject to legal retention duties and any written agreement. Export important data before access ends.
13. Changes to these Terms
We may update these Terms for legal, security, or service changes. We will identify the current version and provide reasonable notice of material changes. If a material update requires renewed acceptance, we will request it before continued paid use.
14. Governing law and disputes
Polish law governs these Terms, without regard to conflict-of-law rules. The parties will first try to resolve disputes in good faith. For professional customers, courts with jurisdiction over Warsaw, Poland will have exclusive jurisdiction unless mandatory law requires otherwise.
